Understanding Stamp Duty

What is Stamp Duty?

Stamp duty is a tax imposed by the Malaysian government on legal documents, including tenancy agreements. It must be paid within 30 days of signing the agreement.

The duty amount depends on the annual rent and lease duration, calculated according to the First Schedule, Item 32(a) of the Stamp Act 1949.

Why Stamp Your Agreement?

Stamped tenancy agreements are legally admissible in court and provide protection for both landlords and tenants in case of disputes.

Late stamping can result in penalties of up to 20 times the duty amount, plus the original duty owed.

Frequently Asked Questions

How is stamp duty calculated?
Stamp duty is calculated based on your annual rent (monthly rent × 12) divided into RM 250 units. The rate per unit depends on your lease duration: RM 1.00 for ≤1 year, RM 3.00 for 1-3 years, RM 5.00 for 3-5 years, and RM 7.00 for >5 years.
What are duplicate copies?
Duplicate copies (also called counterparts) are additional stamped copies of your agreement. Each duplicate costs an additional RM 10.00. Most tenancies need at least one original for the landlord and one for the tenant.
When must I pay stamp duty?
Stamp duty must be paid within 30 days of signing the tenancy agreement. Late payment may result in penalties of up to 20 times the duty amount.
